SALES AND SERVICE TERMS AND CONDITIONS
These are the terms and conditions governing all work, products, sales, and services provided by GeekPad Enterprises LC doing business as (DBA) In Home Answers (“In Home Answers”).
1. All sales and service provided by In Home Answers is subject to the Sales and Service Policies that can be found online at http://inhomeanswers.com/services/sales-and-service-policies/ By signing the Work Authorization you certify that you have read, understand, and accept the Sales and Service Policies.
2. TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN HOME ANSWERS AND ITS AFFILIATES WILL UNDER NO CIRCUMSTANCES BE LIABLE FOR ANY SPECIAL, INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES RESULTING FROM PERFORMANCE OF ANY SERVICE, INCLUDING BUT NOT LIMITED TO LOSS OF REVENUE; LOSS OF ACUTAL OR ANTICIPATED PROFITS (INCLUDING LOSS OF PROFITS ON CONTRACTS); LOSS OF THE USE OF MONEY; LOSS OF ANTICIPATED SAVINGS; LOSS OF BUSINESS; LOSS OF OPPORTUNITY; LOSS OF GOODWILL; LOSS OF REPUTATION; LOSS OF, DAMAGES TO, OR CORRUPTION OF DATA; OR ANY COSTS OF RECOVERY, PROGRAMING, OR RESTORING ANY PROGRAM OR DATA STORED OR USED WITH YOUR PRODUCT AND ANY FAILURE TO MAINTAIN THE CONFIDENTIALITY OF DATA STORED ON YOUR PRODUCT. THE FOREGOING LIMITATION SHALL NOT APPLY TO DEATH OR PERSONAL INJURY CLAIMS. IN HOME ANSWERS SPECIFICALLY DOES NOT WARRANT THAT IT BE ABLE TO (i) SETUP, SERVICE, REPAIR, OR REPLACE YOUR PRODUCT WITHOUT RISK TO OR LOSS OF PROGRAMS OR DATA, AND (ii) MAINTAIN THE CONFIDENTIALITY OF DATA. IF ANY PRODUCT SHOULD BE DAMAGED OR LOST WHILE IN THE CUSTODY OF IN HOME ANSWERS, IN HOME ANSWERS’ LIABILITY WILL BE LIMITED TO THE COST OF REPAIR OR REPLACEMENT OF THE AFFECTED PRODUCT. OTHERWISE, IN HOME ANSWERS’ LIABILITY FOR ANY AND ALL DAMAGE SHALL IN NO EVENT EXCEED THE PAYMENTS RECEIVED BY IN HOME ANSWERS FOR SERVICES PROVIDED PURSUANT TO THESE TERMS. THE REMEDIES SET FORTH HEREIN SHALL BE THE SOLE AND EXCLUSIVE REMEDIES FOR ANY BREACH BY IN HOME ANSWERS UNDER THESE TERMS AND CONDITIONS. IN HOME ANSWERS IS NOT LIABLE FOR LOSS OR CORRUPTION OF DATA OR CONFIDENTIAL, PROPRIETARY OR PERSONAL INFORMATION OR REMOVABLE DATA. BEFORE REQUESTING ANY SETUP, SUPPORT, TRAINING, TROUBLESHOOTING, OR REPAIR, YOU SHOULD MAKE A BACKUP COPY OF YOUR DATA AND REMOVE ANY CONFIDENTIAL, PROPRIETARY, OR PERSONAL INFORMATION AND REMOVABLE MEDIA SUCH AS FLOPPY DISKS, CDS OR PC CARDS.
3. If you have not claimed a product and paid all charges within sixty (60) days after being notified by In Home Answers that your product is ready for return, In Home Answers will consider the product abandoned. In Home Answers will provide such notice to you by the phone number and email address provided at the time the work was authorized. In Home Answers may dispose of your product in accordance with applicable law, and specifically, may sell your product at a private or public sale without liability to you. In Home Answers reserves its statutory and any other lawful liens for unpaid charges.
4. If service includes transferring information or installing software, you represent that you have the legal right to copy the information and agree to the terms of the software license, and you authorize In Home Answers to transfer the information and accept such terms on your behalf in performing the service.
5. These Terms and Conditions are the only ones that apply to work, services, or products provided by In Home Answers. No other oral or written terms or conditions apply, including ones in any purchase order that you provide to In Home Answers. No one from In Home Answers has the authority to vary any of these Terms and Conditions.
6. In Home Answers products are subject to United States and foreign export control laws and regulations, and must be purchased, sold, exported, re-exported, transferred, or used in compliance with such export laws and regulations.
7. You agree and understand that it is necessary for In Home Answers to collect, process, and use information about you to perform its work under these Terms and Conditions. In Home Answers will protect your information in accordance with the In Home Answers privacy policy available at inhomeanswers.com/privacy.
